Democrats can now launch process to invoke never before used rule that could remove Trump from the White House
To keep the vice president in power against the president’s objection, a two-thirds majority in both the House and Senate would be necessary.
That would be a significant obstacle for Democrats, who are unlikely to control anywhere near enough seats to reach that threshold.
Nevertheless, the political consequences of such a move could be enormous, even if Trump ultimately remained in office.
Why the commission could create a political storm
An independent body of physicians and former government officials examining the fitness of a sitting president would be unprecedented.
Its findings could generate weeks or even months of political controversy, particularly if the commission raised serious concerns about Trump’s ability to carry out his duties.
It would also put Vice President JD Vance in an extremely difficult position.
He could face pressure to choose between standing behind Trump or supporting the conclusions of an independent medical commission.
Either decision could have enormous implications for his political future.
The debate would also move beyond television commentary and social media speculation. Instead, the president’s fitness would become the subject of a formal constitutional process.
Questions about Trump’s health have already attracted attention
Trump’s physical and mental health have repeatedly become subjects of public discussion.
Forensic psychologist Dr. John Paul Garrison has raised concerns about what he describes as possible neurological decline, pointing to observations involving Trump’s speech, movements, and apparent difficulty finding words.
There have also been reports concerning his weight, bruising on his hands and other aspects of his medical condition.
Some independent medical professionals have commented on publicly available information, while Trump’s medical team has offered its own explanations.
However, public observations and speculation should not be confused with a medical diagnosis.
None of these reported incidents, by themselves, establishes that Trump is incapable of serving as president.
An independent commission would provide a formal mechanism to investigate such questions rather than leaving them to political commentators and competing interpretations of publicly available footage.
Trump’s response to the Democratic victory
Trump has already reacted to the election results.
According to AP, he sought to distance himself from the Republican losses, arguing that voters had rejected the candidates rather than him personally.
In a late-night interview with Fox News, he said he did not consider the results a personal defeat.
”My message is, congratulations to the Democrats, and I look forward to working with you for the good of our country,” he also told CBS.
He also vowed to veto legislation passed by the Democratic-controlled Congress.
Meanwhile, Hakeem Jeffries has outlined an agenda focused on lowering the cost of living and more aggressively overseeing the Trump administration.
The Democrats’ new majority is expected to make Trump’s final two years in office considerably more difficult.
Will Democrats actually use the 25th Amendment?
That remains the big unanswered question.
Winning control of Congress does not automatically mean Democrats will attempt to establish the commission or invoke Section 4.
Such a move would almost certainly provoke an enormous political backlash from Republicans, who would likely portray it as an attempt to overturn the will of voters.
Democratic leaders may instead concentrate on investigations, oversight and legislative battles.
But the constitutional framework already exists, and the idea of creating an independent commission has been discussed at the highest levels of government before.
For 59 years, the provision has remained an unused part of the 25th Amendment.
Now, with Democrats preparing to take control of both chambers of Congress, a proposal that once went nowhere could return to the center of Washington’s political debate.
Whether they decide to take that step could become one of the most consequential questions of Trump’s remaining time in office.
